This action was commenced by the lodgment of the summons on the 3d day of June, 1893. The *25complaint contains two distinct causes of action, one for the settlement of a partnership between plaintiff and defendants and for a dissolution of such partnership, and another for the recovery by the plaintiff from the defendants for over $48,000; which the plaintiff avers he laid out and expended at the request and for the benefit of defendants, and which sum they have neglected and refused to pay.
