In April, 1904, J. B. Gibson filed suit against W. A. Ray and J. C. Frazier, in wiMeb be alleged that be was tb'e owner of and entitled to the immediate possession of a certain lot of tobacco, amounting to about 5,500 *507pounds, which he claimed to have purchased from them; that the defendants were unlawfully detaining the tobacco from him to his damage in the sum of $385.
