On March 15, 1928, defendant in error, John Gourney, (to whom we will herein refer as the employee,) while in the employ of plaintiff in error, the Old Ben Coal Corporation, (herein referred to as the employer,) received an accidental injury arising out of and in the course of his employment. On August 31, 1928, the employee filed with the Industrial Commission an application for adjustment of his claim for compensation.
