These are four actions of tort brought by the occupants of an automobile after a collision between the car in which they were riding with one alleged to be owned and operated by the defendant. The four cases were tried together in the District Court and on appeal were consolidated in one report made by the trial judge “as a matter of discretion”. In the original report filed by him he stated he reported the case “as a matter of discretion upon two issues, the sufficiency of the evidence first as to the identity of the defendant and second as to the defendant’s negligence”.
