This appeal arises out of a personal injury action in which plaintiff alleged that he was injured when his employer negligently rigged a crane, causing a cable to snap and a piece of granite to fall on plaintiff. Plaintiff argues that it was error for the trial court to grant summary judgment because there is a genuine issue of material fact as to whether defendant, who was the president and owner of the granite company at which plaintiff worked, was acting as an employer or a co-employee when the incident occurred.
