Carter v. Hutto
Court of Appeals for the Fourth Circuit
1Opinion of the Court
HARRISON L. WINTER, Chief Judge:
The district court entered judgment for defendants in plaintiffs pro se action under 42 U.S.C. § 1983 alleging that correctional officers of the Richmond City Jail illegally seized and destroyed certain of his legal papers while conducting a search of his cell. Plaintiff appeals; we vacate the judgment and remand the case for retrial. In our view, the district court committed reversible error in overly strict enforcement of its pretrial order and in failing to explain asserted non-compliance to a pro se litigant and afford him an opportunity to comply strictly.
