By information defendant was charged with the murder of his wife. He pleaded not guilty and not guilty by reason of insanity. On July 18, 1958, a jury found him guilty of murder of the first degree. Thereafter the issue of punishment was tried before the same jury. It was unable to reach a verdict and was discharged on July 22, 1958. A second trial on the issue of punishment before another jury commenced on August 12, 1958, and the jury fixed the punishment at death.
