SELYA, -Circuit Judge.

This appeal requires-us to address, for the first time, a “safe harbor” regulation promul gated by the Secretary of Labor (the Secretary) as a means of exempting certain group insurance programs from the strictures of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001-1461. Determining, as we do, that the district court appropriately applied the regulation, and discerning no clear error in the court’s factual findings on other issues in the case, we affirm the judgment below. 1994 WL 587801.
