Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered September 21, 1977 and October 4, 1977, convicting him of assault in the first degree and criminal possession of a weapon in the fourth degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and new trial ordered. Defendant was charged, inter alia, with assault in the first degree as a result of a stabbing incident.
