About nine o’clock in the evening, December 31, 1922, plaintiff in error, Edward Allen, while driving his taxicab west on Twenty-second street, at the intersection of that street and Western avenue, in Chicago, struck with his machine two young girls, Mary Rómpala, aged thirteen years, and Helen Smalarz, aged fourteen years. Mary Rómpala died as a result of the injuries she received. Allen was indicted in the criminal court of Cook county on the charge of manslaughter for the killing of Mary Rómpala.
