Appeal by the defendant, The City of New York, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 27th day of September, 1906, denying the defendant’s motion . to vacate an injunction pendente lite restraining the city from physically closing West One Hundred and Fifty-first street between the Boulevard and Twelfth avenue.

The plaintiff is the owner in fee simple of certain property lying on both sides of Twefth avenue and.extending from One Hundred and Fifty-first street to One Hundred and Fifty-second street in the borough of Manhattan, city of New York. One parcel lies between the easterly line of Twelfth avenue and the westerly line of the land occupied by the Hudson River railroad, being a strip eleven feet ten inches wide on the north side of One Hundred and Fifty-first street, two hundred and eight feet four and one-half inches long to the south side of One Hundred and Fifty-second street,…
