In this cause due notice was given of the time and place of settling the statement of facts, but upon the day fixed, the appellant, through what the court below deemed an excusable inadvertence, failed to call the matter to the attention of the court. Four days later, after notice to the respondent, the court entertained a motion to enter a nime pro tunc order, as of the date fixed for the settlement, adjourning the proceeding.
