At issue before the Court is defendant TRW, Inc.’s motion for summary judgment and the response of plaintiff, Phoenix Technologies, Inc. On October 9, 1992, plaintiff filed a six count complaint against defendant, stating claims for breach of contract, breach of an implied covenant of good faith and fair dealing, bad faith tort, fraud and misrepresentation, negligent misrepresentation and promissory estoppel/detrimental reliance.
