McCALEB, Justice.

This is a suit to recover damages for malicious prosecution. The substance of plaintiff’s claim is that he was arrested on September 29, 1941, at the instance of his employer, Railway Express Agency, Inc., acting through its investigator, A. M. Posey, and charged with the embezzlement of various articles of merchandise; that, after a trial in the Criminal District Court, he was found not guilty by a jury; that the prosecution was malicious and unjust and that, as a result, he has been damaged in the sum of $23,000 for which the defendants, Railway Express Agency, Inc. and A.…
