This is an action in damages for an alleged malicious prosecution. The answer is a general denial.

The case presented by the record is, substantially, as follows, to-wit:

Plaintiff and defendant are natives of the parish of St. Landry, and residents of the town of Opelousas, the former being the tax collector *203of the town and the latter a member of the bar.
