OPINION

MIRABAL, Justice.

This is an appeal from an order dismissing appellant’s suit, with prejudice, for failure to state a claim against the defendant. We reverse and remand.

Appellant, Dan Thomas, a state prison inmate, filed a pro se in forma pauperis suit on April 11, 1991, against James A. Collins, the Director of the Texas Department of Criminal Justice — Institutional Division.
