This is an appeal by the appellants, defendants below, from a judgment of the Hancock Cir*241cuit Court. The cause of action was for specific performance and damages arising out of the failure of the appellant, Floyd Parsley, to fulfill the terms of a contract he made with the appellees to build a nome in the city of Indianapolis.
