Appellant was first tried by a general court-martial composed of officer and enlisted members in January, 1987, at Butzbach, Federal Republic of Germany. He was convicted of one specification each of premeditated murder and forcible sodomy in violation of Articles 118 and 125, Uniform Code of Military Justice, 10 U.S.C. §§ 918 and 925 (1982) respectively [hereinafter UCMJ], His sentence, approved by the convening authority, included a dishonorable discharge, confinement for life, total forfeitures, and reduction to Private El.
