OPINION

FERNANDEZ, Judge.

Appellee Billie Groshong was charged with manslaughter, a class three felony, after he was involved in an automobile accident, allegedly while intoxicated, which resulted in the death of the driver of another vehicle. The state appeals from the trial court’s granting of Groshong’s motion to suppress three blood samples. In his cross-appeal, Groshong challenges the trial court’s denial of his motion to dismiss the *69charge because of prosecutorial misconduct.1
