On August 19, 1930, the board of education of the city of Niagara Falls entered into a written contract with the defendant William A. Walker for the erection of said school building. Walker entered upon the performance of his contract, and on or about October sixth had practically completed his work. Some few things then remained to be done of minor importance, but Walker did no further work after October twenty-second.
