Batchelder, Presiding Judge.
Appellant, Allstate Indemnity Company (“Allstate”), appeals the judgment of the Summit County Court of Common Pleas. We reverse.
On November 18, 1998, Alvin Banks filed an action for breach of contract against Allstate. On December 17, 1998, Allstate filed a notice of removal to the United States District Court, Northern District of Ohio, Eastern Division (hereinafter “Federal District Court”).
