The plaintiff, John F. McBurney, appeals from an order entered in the Superi- or Court in favor of the defendant, Household Bank, S.B., N.A., 1 staying his claim of libel per se and compelling arbitration in accordance with the terms of the parties’ credit card agreement. Essentially, the plaintiff argues that because his complaint includes a claim for punitive damages, a preliminary evidentiary hearing in Superior Court pursuant to Palmisano v. Toth, 624 A.2d 314 (R.I.1993) is required; therefore, arbitration is not a proper forum.
