At the inception of thé transaction which is the subject of this litigation, the plaintff was the owner of a farm of 96 acres, in Plymouth County, Iowa, of the value *30of $175 per acre, and the defendant, as a real estate agent, had upon his list of lands a farm of 315 acres in Minnesota, belonging to Gilbert Odland and Neis Anderson, which he was authorized to sell at $95 per acre.
