On June 23rd, 1931, the majority of this court, with which the writer concurred, sustained the demurrer of the relator to the answers filed by the respondents. On this, the 2nd of July, 1931, the above cause came on to be heard upon a petition for rehearing filed by respondents, a petition of the respondents for leave to file an amendment to their former answer, motion of relator that absolute or peremptory writ of prohibition do issue, and a petition of respondent that, if this court should grant the peremptory writ of prohibition, provision may be made that the Circuit Court may retain…
