School Dist., pending in the Supreme Court, Suffolk County, under index No. 04/26703, the defendants third-party plaintiffs appeal from an order of the Supreme Court, Suffolk County (Costello, J.), dated May 20, 2008, which granted the motion of the third-party defendants pursuant to CPLR 3211 (a) (1) to dismiss the third-party complaint.
