Appeal from District Court, Hemphill County; F. P. Greever, Judge. Action by the National Bails of Commerce, doing business in Kansas City, Mo., against the Third National Bank of Springfield, Mass., and others. From a judgment for plaintiff, defendant named appeals.

This suit was instituted by the National Bank of Commerce doing business in Kansas City, Mo., against J. H. Ken-ney, P. W. Kenney, J. W. Lambert, and the Third National Bank of Springfield, Mass., on a promissory note executed by said J. H. Kenney, indorsed by P. W. Kenney and J. W. Lambert, and secured by a chattel mortgage on certain personal property. It was alleged that the Third National Bank of Springfield, Mass., had converted to its own use property upon which said chattel mortgage had been given.
