Kassal, J.

The action was brought by plaintiff, an attorney who is also the insured, inter alla, for a declaratory judgment directing that Government Employees Insurance Co. (GEI-CO) was obligated to furnish a defense to plaintiff in a legal malpractice action presently pending in Supreme Court, Nassau County, and to pay any judgment entered therein. The complaint herein also seeks $100,000 in damages and for expenses incurred as a result of the refusal by the insurer to assume the defense of that action.
