The plaintiff is the sole surviving trustee under ■ the last will and testament of Henry B. Gibson, and brings this ac*568tion. to obtain, the direction of the court as to the final distribution of the trust property remaining in his hands and for a judicial settlement of his accounts. This involves and requires the construction of the will on several points. The will was made on the 21st day of September, 1863, and the testator died on the 20th day of November, the same year, and his will was soon thereafter duly admitted to probate.
