JOHNSON, Judge:

John P. Laskaris appeals from the Order dismissing his Post Conviction Relief Act (PCRA) petition without a hearing. We affirm.

On March 9, 1981, a criminal complaint was filed against Laskaris charging him with Criminal Attempt, Robbery, Conspiracy and Theft by Receiving Stolen Property concerning events that occurred on October 1 or 2,1979. However, the police were unable to arrest Laskaris because Laskaris was incarcerated on unrelated charges in West Virginia at that time.
