This matter came on to be heard by the Court on the 27th day of February, 1964, upon the pleadings of the parties and evidence adduced at the trial. Upon completion of the Plaintiff’s evidence, the Defendant moved the Court for dismissal on the basis that Plaintiff was outside the purview of Chapter 1703, Revised Code, and therefore was not properly before this Court.
