The plaintiff initiated this action by a complaint in two counts, negligence and nuisance, to *165recover damages for personal injuries sustained as a result of a diving accident in a lake owned by the defendant.1 From the granting of a summary judgment, on both counts, in favor of the defendant, the plaintiff has appealed.
