Three principal positions are taken by counsel, as to the original opinion.

27. (1) That the court was in error in holding that the conveyance by Dewey tó Susan W. Sinclair was in legal effect a conveyance to Joseph F. Sinclair and Proudfoot, and in holding in that particular that §4024 Bums 1908, §2981 R. S. 1881, applied, and insisting that the conveyance falls within §§4017, 4019 Burns 1908, §§2974, 2976 R.
