Following a jury trial in the circuit court of Peoria County, the defendant, Joseph Miller, was convicted of six counts of first degree murder. 720 ILCS 5/9 — 1(a) (West 1992). The same jury found the defendant eligible for the death penalty on the basis of the defendant’s having killed more than one individual. 720 ILCS 5/9— 1(b)(3) (West 1992). The jury determined that there were no mitigating factors sufficient to preclude imposition of a sentence of death. The trial court sentenced defendant to death. The defendant’s sentence has been stayed (134 Ill. 2d R. 609(a)) pending direct appeal…
