MAGILL, Circuit Judge.
This case involves a determination of whether a jury could have reasonably concluded, based on the evidence presented, that John Gildersleeve (Gildersleeve) defrauded plaintiffs based on Arkansas common law fraud and violations of the Commodity Exchange Act (CEA), 7 U.S.C. § 6b (1988). Robert MeAnally and Delbert Whorton (collectively, the plaintiffs) appeal the district court’s1 grant of judgment as a matter of law and, in the alternative, the district court’s judgment for a new trial.
