OPINION

WEISBERG, Judge.

Jack Krum (“petitioner”) seeks review of the trial court’s summary dismissal of his petition for post-conviction relief. For the following reasons, we grant review and grant relief.

FACTUAL AND PROCEDURAL BACKGROUND

On October 17, 1989, petitioner pled no contest to attempted sexual abuse, a class 3 felony, dangerous crime against children in the second degree. The victim was his step-granddaughter.
