Following a series of news reports by KTRK Television, Inc. alleging financial mismanagement, Benji’s Special Education Academy (“BSEA”), a charter school, and Theaola Robinson sued KTRK. KTRK moved to dismiss the action pursuant to the then-recently enacted Texas Citizens Participation Act (“TCPA”). 1 In a written order, the trial court denied the motion. In five issues, KTRK contends that the trial court erred in denying KTRK’s motion to dismiss.
