Winburn Stewart, Sr. (“Stewart”), and his wife Mary Stewart, as trustee of an irrevocable life insurance trust, brought this tort and contract action against Bibb Distributing Company and Winburn Stewart, Jr. (known as “Brother”). In its verdict, the jury determined the contractual rights and obligations of the parties and awarded the Stewarts tort damages, both actual and punitive, as well as attorney fees and litigation expenses.
