¶ 1 Appellant, Harold Pollard, appeals from the order entered in the Philadelphia County Court of Common Pleas, dismissing his first petition brought pursuant to the Post Conviction Relief Act (“PCRA”).1 We affirm.

*1006¶ 2 The relevant facts and procedural history of this appeal are as follows. On the evening of December 23, 1999, Philadelphia Police Officer Arthur Herder was conducting plainclothes surveillance in Southwest Philadelphia.
