In the proceedings before the Industrial Commission, which resulted in an award of death benefits to be paid by plaintiffs to- Minnie Berg on account of the fatal in jury of her husband, Peter Berg, while in the employ of the plaintiff, Clarence Berg, it appeared that the injury was sustained under circumstances entitling him to compensation benefits; that he died on October 20, 1937; and that Minnie Berg is his widow.
