Fetitioner, William Swope, was adjudicated a sexually violent person pursuant to the Sexually Violent Fersons Commitment Act (Act) (725 ILCS 207/1 et seq. (West 2000)). The circuit court of Ogle County committed Swope to the custody of the Department of Human Services (DHS). Swope subsequently petitioned the circuit court for conditional release. The circuit court denied Swope’s petition and the appellate court affirmed. 343 Ill. App. 3d 152. We allowed Swope’s petition for leave to appeal (177 Ill. 2d R. 315(a)).
