Mrs. Maud Sutton, Mrs. Birdie Perry, Lily J. Smith by her next friend, W. M. Harper, for himself, and as next friend of three minor children, filed a petition in the court of ordinary, praying that a probate in common form of the alleged will of Joseph Smith be set aside, that the letters testamentary issued to Lily May Smith be revoked, and that the'executrix be required to-prove the will in solemn form.
