MEMORANDUM

MERHIGE, District Judge.

Twenty-nine named plaintiffs, all of whom are engaged in various facets of the commercial seafood industry in and about the Chesapeake Bay, filed this suit as a class action against the defendant, Allied Chemical Corporation (“Allied”). Plaintiffs allege, on behalf of themselves and all others similarly situated, that Allied, acting through its agent Life Science Products, Inc., discharged toxic effluents associated with the manufacture of Repone, resulting in the pollution of the James River, the Chesapeake Bay, their tributaries, and adjacent waterways.…
