We consider an appeal and cross-appeal from an order of the district court for the Western District of Kentucky granting judgment n.o.v. in a civil rights action based upon 28 U.S.C. § 1343(3) and (4) and 42 U.S.C. § 1983. The district court’s opinion is reported at 384 F.Supp. 1269 (1974). Plaintiff-appellant Elmer Scharfenberger was a prisoner at the Kentucky State Penitentiary at Eddyville. He alleged in his complaint that he suffered two amputation operations to his right arm because he was denied adequate medical treatment during his incarceration. The defendants…
