MEMORANDUM OF DECISION

Defendant Charles Duck (“Duck”) is a former bankruptcy trustee who was convicted of embezzlement from various bankruptcy estates and is now incarcerated. Duck is also a debtor in this chapter 11 case in which a trustee has been appointed. Plaintiff Paul W. Dickinson (“Dickinson”) was a creditor in a chapter 11 case in which Duck served as a trustee (the “Borelli case”).
