The Bank of Blount county has appealed from the Chancellor’s decree that a deed of A. D. Dunn to D. S. Bird and Grace Waters of July 6, 1926 was not fraudulent in fact as well as in law. In the deed the consideration recited was $6500 paid in cash, but- it appeared that when the bill was filed on July 9, 1926 the conveyees had paid only $1271.38 of the consideration, though they were preparing to pay $5000 to one John Martin in satisfaction of a vendor’s lien note held by him and the balance in settlement of taxes on the property.
