This was an action of assumpsit brought in the Circuit Court of Cook county, by Cobb, Blaisdell and Company against Bacon, and Company, to recover damages for overpayment on corn delivered by the defendants to the plaintiffs, and damages for the non-delivery of other corn which it was alleged the defendants had promised to deliver at Cairo, to the plaintiffs. The different phases of these claims are set out in eight special counts of the declaration, concluding with the common counts. The whole amount claimed was $12,207.89.
