On the 4th day of December, 1944, about eight o’clock in the evening, Mr. Harold Leonard, a resident of Utica, New York, parked his Buick automobile in a parking lot owned and operated by the defendant in the downtown section of Utica. When he returned to the parking lot about an hour later to get his car, it was missing. After Mr. Leonard and the attendant at the parking lot had searched for the car and were unable to find it, they were informed that the car had been found by the police in a damaged condition against a telephone pole at a point about a half-mile distant from the parking…
