Action to recover damages for negligently causing the death of the plaintiff’s intestate, brought to the Superior Court in New London County and tried to the jury before Curtis, Jverdict and judgment for the plaintiff for $500, and appeal by the defendant. The defendant objects to the charge, upon the ground that it did not sufficiently impress upon the minds of the jury the fact that the plaintiff was bound to establish freedom from negligence on the part of himself and his intestate. By this statement it is not intended to complain of the court’s instructions upon the subject of imputed negligence. The court went to the full extent of the defendant’s requests hrthis regard, and told the jury that the contributory negligence of either the plaintiff, who was driving the horse, or his intestate, would bar recovery.
