The parties to this appeal describe this suit as an action in the nature of trespass to try title to 65 1/2 acres in Washington County, Texas. The suit was instituted by appellee against Prudie V. Howard Barber and husband, and Birdie E. Branch and husband. Plaintiff's petition did not contain the formal allegations of an action in trespass to try title. Plaintiff alleged in substance that on April 14, 1928, he conveyed the land to Prudie V.
