Plaintiff brings this action in replevin as administrator with the will annexed, of the estate of Elizabeth Eaton, deceased, whose will was probated by the probate court of Washtenaw county, Mich., to recover the property, in the state of New York, of the 'said estate, from the defendant, the administrator with the will annexed of the same estate, appointed by the Surrogate’s Court of Madison County, N.
